NBC: Obama to Pick Kagan Monday

NBC reports that President Obama will pick Solicitor General Elena Kagan to replace retiring Justice John Paul Stevens.

My Take
Well, I am not surprised that Obama shied away from picking a person with more solid liberal/progressive credentials. Now remind me again why liberals were euphoric over his election?

She's liberal enough. And, she works well with others with different views. She's just the kind of person to bring Kennedy over to the side of the moderates. She's a much better pick than a far left point of view who would carry no sway with Kennedy.

How do you know "she's liberal enough"?

Also, she could easily be Kennedy and join him to give the rightwing bloc a 6-3 majority on important issues. The job is not to "sway" Kennedy, but to hold things constant with the number of liberal judges. It is pure speculation to think that Kagan will move Kennedy. She didn't even convince him to vote against the corporations in Citizens United.

Except I think it was Greenwald who said she just forgot about relevant case law. Presumably on the bench he could remind her in closed quarters, no? Private schooling?

Decidere: I do remember hearing about her stumbling during the oral argument. Another law professor on Concurring Opinions just described her handling of the case as a "disaster."
