Is Justice Stevens Preparing to Retire?

The buzz: 89-year-old Justice Stevens is going to retire.

The evidence: Stevens hired only one clerk for next year's term -- instead of the usual four.

The impact: President Obama would have a second pick for the high court. Because the likely outcome would involve switching one liberal for another, the ideological impact on the Court would be limited in the short term.

Any others: Justice Ginsburg?

Ginsberg says she plans to stay for a while; unfortunately no matter who Stevens' replacement is, the progressive wing of the court will be weakened because of the loss of Stevens' seniority status.

If you count votes, the ideological balance should remain the same. This matters more than seniority (in most cases). Some judges evolve into liberal or conservative or moderate positions. Many of them are defined once they arrive.
